2. Information We Collect
Business enquiries
When you submit an enquiry through ATHAR for Businesses, we collect your name, email address, business name, information about your business challenges and the outcome you hope to achieve.
You may also provide a website or social media handle and information about your budget readiness.
Creator applications
When you apply through ATHAR for Creators, we collect your name, email address, main platform or handle, content niche, approximate audience size, information about recurring audience questions, previous digital product experience and product interests.
You may also provide additional notes.
Meetings and correspondence
If you contact us or arrange a meeting, we may collect your contact details, booking information, correspondence and information you choose to share.
Technical information
Website infrastructure and external providers may process technical information, including IP addresses, browser and device information, connection details and security-related records.
3. Why We Use Your Information
We process information for the following purposes:
Responding to business enquiries and creator applications: To review your request, assess a possible engagement and communicate with you. Where permitted by applicable law, this processing is necessary to take steps at your request before potentially entering into an agreement.
Scheduling meetings: To arrange and manage meetings you request in connection with potential work or partnerships.
Website security and operation: To maintain the availability and security of our services, prevent misuse and manage technical problems. Processing is based on applicable operational interests or other lawful grounds available under the relevant law.
Legal obligations and disputes: To comply with applicable legal requirements or establish, exercise or defend legal rights where necessary.
Website analytics: To understand general website traffic and performance, as explained in Section 5.
Where consent is legally required for a particular activity, we will seek it before undertaking that activity.
We do not currently use business enquiries or creator applications for unrelated bulk marketing campaigns, and we do not sell personal information submitted through our forms.
4. Service Providers and Data Sharing
ATHAR uses the following services:
Formspree processes submissions from the Businesses enquiry form and Creators application. Form submissions are delivered to the relevant ATHAR email inbox.
Namecheap Private Email provides business email services and stores correspondence received through our mailboxes.
Cloudflare provides website delivery, security and analytics services.
Cal.com supports appointment scheduling where booking functionality is available.
We may also share information where required by applicable law or reasonably necessary to protect legal rights.
ATHAR's public website does not maintain its own separate database of enquiries or creator applications. Information submitted through the forms may nevertheless be stored by Formspree and in our email accounts.
5. Analytics and Cookies
Cloudflare Web Analytics is enabled for atharcommerce.com and provides website traffic and performance information where active.
According to Cloudflare, its Web Analytics service does not use analytics cookies or visitor fingerprinting.
At the time of ATHAR V2's technical audit, no advertising pixels, Google Analytics integrations or other marketing-tracking scripts were detected.
Some external services, particularly appointment-booking interfaces, may use cookies or other technical mechanisms when accessed.
If our website-tracking practices change, we will update this Policy and implement any additional legally required notices or controls.
6. Data Retention
For business enquiries and creator applications that do not result in an engagement, we retain relevant information for up to 12 months after the last meaningful interaction, unless earlier deletion is appropriate or a longer retention period is legally necessary.
We intend to apply the same period to unsuccessful preliminary meeting enquiries and related correspondence, subject to the booking provider's available controls.
Information relating to active clients or partners may be retained for the duration of an engagement and for additional periods required by applicable contractual, accounting, tax or legal obligations.
Information may be held in both external service accounts and email inboxes. Records under our control are subject to periodic review and deletion in accordance with this Policy.
Service providers may have their own backup and technical-retention schedules.
7. International Processing
ATHAR conducts activities across Nigeria and the United Arab Emirates and may receive enquiries from individuals in other countries.
Our website, communications and booking providers may process information in countries other than the country in which you are located.
International processing is subject to applicable data-protection requirements. We will assess and apply required transfer protections where relevant.
For further information about the providers involved in processing your information, contact privacy@atharcommerce.com.
8. Security
We take reasonable steps to protect personal information, including using the access controls and security features available through our service providers.
However, no internet-based transmission or storage system is completely risk-free.
Please do not submit passwords, financial account credentials, sensitive personal information or confidential third-party records through our general enquiry and application forms.
9. Your Privacy Rights
Depending on the applicable law and circumstances, you may have the right to:
- Access personal information held about you.
- Request correction of inaccurate or incomplete information.
- Request deletion where legally appropriate.
- Object to or request restriction of certain processing.
- Withdraw consent where processing relies on consent.
- Request transfer of your information where applicable.
- Challenge certain automated decisions, where relevant.
ATHAR does not currently use solely automated decision-making to accept or reject business enquiries or creator applications.
To exercise your rights, email privacy@atharcommerce.com.
We may request reasonable verification of your identity before disclosing or deleting information and will respond in accordance with applicable legal requirements.
You may also raise a complaint with a relevant data-protection authority, including the Nigeria Data Protection Commission where Nigerian law applies.
10. Studio Lumen and External Websites
ATHAR showcases Studio Lumen, a fictional business used to demonstrate a custom-built application.
The Studio Lumen interactive demonstration is hosted separately at https://studio-lumen.atharcommerce.com/demo.
Its demonstration experiences are designed to use fictional information and simulate interactions without creating genuine project enquiries or changing private business records.
Visitors should use fictional details rather than real personal or confidential information when exploring the demonstration.
The separate hosting service may process technical information when the demonstration is accessed.
Other external websites and platforms linked from ATHAR may have their own privacy policies and practices.
11. Children's Privacy
ATHAR's services and forms are intended for professional and business-related enquiries and are not directed towards children.
We do not intentionally solicit children's personal information through our general website forms.
12. Changes to This Policy
We may update this Policy to reflect changes to our services, providers, operating arrangements or legal requirements.
The current version will be published on this website with its effective date.
